Under the EB-3 process, Premium Processing is only available for the Form I-140, which is the Immigrant Petition for Alien Workers. Based on current processing times for the other forms required for EB-3, the I-140 processing time is not currently having a significant impact on when applicants receive their green card.
• Consular Processing means you’re completing your visa interview at a U.S. embassy or consulate outside the U.S.
• Adjustment of Status (AOS) is available to individuals already in the U.S. on a qualifying visa. However, not all immigration categories are automatically eligible for AOS. Your BDV advisor can help determine if this option is right for your specific case.
Switching between the two is sometimes possible, but must be evaluated case-by-case. Let your BDV representative or attorney know your current situation and goals.
If you’re using Adjustment of Status, travel can be restricted unless you’ve been issued Advance Parole. Always consult your immigration attorney or BDV advisor before planning any travel.
The Priority Date under EB-3 is the date your labor certification is filed with the U.S. Department of Labor. This date determines your place in line for a visa and is very important in the EB-3 process.
When your Priority Date becomes current, you can proceed to the next step of your visa processing. We’ll notify you when that time comes and guide you through the next steps.
