DOL Latest News
A major development at the DOL in October was the Senate confirmation of key leadership nominees, effectively setting the agency's full leadership slate in place . Andrew Rogers was confirmed as the new Wage and Hour Administrator, a role in which he will oversee the division responsible for enforcing the Fair Labor Standards Act (FLSA) and is expected to ramp up the administration's opinion letter program, which can impact wage determinations for unskilled roles . Jonathan Berry was also confirmed as the Solicitor of Labor, the DOL's chief legal officer.
With this leadership in place, the DOL signaled its intent to press forward on key rulemakings, including clarifying joint employer and independent contractor status, a classification that can sometimes affect unskilled labor arrangements . The agency also announced it was expanding its PAID (Payroll Audit Independent Determination) program to include Family and Medical Leave Act (FMLA) issues, encouraging employers to self-report potential violations . On a broader scale, the DOL welcomed several other newly confirmed senior appointees to carry out the Administration's mission.

October 2025 BDV Immigration Update
October 1st marked the start of the new U.S. government fiscal year, and as anticipated, a fresh batch of immigrant visas for the EB-3 Unskilled (Other Workers) category became available. This annual recalibration immediately translated into tangible results, with BDV securing its first Green Card approval for unskilled workers in weeks. This uptick in approvals follows a period where visa unavailability had created a backlog, and the more than 70 interviews held in September began to bear fruit. While Labor Certification approvals paused due to the fiscal year cap reset, the focus remained on converting prior efforts into permanent residency.
BDV Approvals (October 2025):
-
38 - Green Card approvals
-
0 - Labor Certification (PERM) approvals (due to visa cap)
-
168 - I-140 approvals
