DOL Latest News

The Department of Labor (DOL) released its updated Office of Foreign Labor Certification (OFLC) processing queues at the end of June, highlighting where the agency stands on historical backlogs. On the regulatory front, the DOL officially signaled its intent in the new federal Unified Agenda to advance a highly anticipated proposed rule titled "Modernizing the Labor Market Test and Improving Protections for US Workers in the PERM Immigrant Visa Program," which marks the first comprehensive attempt to overhaul and modernize the PERM process since 2004.

Regarding operational wait times, standard PERM analyst reviews are currently taking an average of 403 calendar days (roughly 13 to 14 months) from the date of filing. The agency reported it is actively adjudicating clean June 2025 PERM filings, while cases selected for audit reviews are hovering around December 2025 submissions.

For the initial stage of the pipeline, the National Prevailing Wage Center (NPWC) is currently issuing Prevailing Wage Determinations (PWDs) for OEWS-based PERM requests filed in April 2026, and non-OEWS requests filed in March 2026, keeping the upfront wage determination wait time down to a stable 3-month window.

June 2026 BDV Immigration Update

As summer arrived, June brought dynamic movement and significant updates across the employment-based immigration sector. The release of the upcoming Visa Bulletin sparked notable progress for EB-3 applicants across multiple chargeability zones, balancing out ongoing restrictions in other high-demand tiers. Internally, the BDV operations team maintained high productivity, vigorously pushing forward with case preparation to leverage the mid-summer advancements and lock in critical filing timelines for our clients.

 

BDV Approvals (June 2026):

  • Green Card approvals: 23

  • Labor Certification (PERM) approvals: 338

  • I-140 approvals: 117

USCIS Visa Bulletin

The July 2026 Visa Bulletin has been officially released, and USCIS has confirmed it will continue to enforce the Final Action Dates chart (Chart A) for all employment-based Adjustment of Status (I-485) filings. While certain categories like EB-2 India faced heavy constraints (becoming completely unavailable for the rest of the fiscal year), the EB-3 category experienced broad, healthy forward movement across almost all regions.
